Terms and conditions
These terms apply when your business buys any plan or item from us. Please read them before you order. Our subscription terms, refund and cancellation policy and AI terms and conditions also apply and form part of these terms.

1. About us
We are The Powerful Group Limited, trading as Powerful Digital Marketing (“we”, “us”, “our”). We are registered in England and Wales, company number 09629669, at 124 City Road, London EC1V 2NX. VAT number GB527555766.
You can contact us by email at info@powerfuldigitalmarketing.com.
“You” means the business buying from us, and the person ordering on its behalf.
2. Business customers only
We sell only to businesses, including sole traders, buying for the purposes of their trade, business or profession. We do not sell to consumers.
When you place an order, you confirm that you are buying for business purposes and not as a consumer, and that you are authorised to accept these terms for your business. You will be asked to confirm this at checkout.
Because you are buying as a business, the consumer rights to cancel within 14 days under the Consumer Contracts Regulations 2013 do not apply. If anyone does buy from us as a consumer, they keep any rights the law gives consumers, which these terms cannot remove.
3. Our contract with you
When you place an order on our website, you are offering to buy. The contract between us starts when we send you an email confirming your order. If we cannot accept your order, we will tell you and will not charge you.
4. What we provide
We provide the plans and items described on our website, such as SEO and AI visibility, Google and AI indexing, articles, social media and Google Business posts, Google review replies, Google and Meta ads management, email newsletters, email automations, a digital magazine, product listings, Powerful Bots (AI chatbots), Powerful Pages (website pages at scale), Powerful Local (Google Business Profile care and directory listings), Powerful PR (press releases written and distributed), Powerful Images (animated images), Powerful Podcasts (AI-voiced podcasts), Powerful Presentations (designed slides and pages) and Powerful Intel (competitor reports).
Each plan’s page says what is included and how much of it you get each month. Our service is delivered using AI and automation, with human oversight.
We aim to start work within 5 working days of receiving everything we need from you.
5. What we promise, and what we do not
We only promise what we make ourselves (articles, posts, listings, pages, checks and reports), never rankings, links or traffic.
Search engines, AI tools and social platforms decide for themselves what they show. So we do not guarantee rankings, backlinks, directory listings, traffic, leads, sales or any other result. Results shown on our website are real results from our work for clients and our own businesses, but they are examples, not a promise of what you will get.
We do not guarantee press coverage or publication: news sites and editors decide what they publish. Directories decide if and when listings go live.
6. What we need from you
You agree to:
- give us the access and information each plan needs, as listed on its page, and keep it working;
- make sure everything you give us (text, images, logos, product details and business information) is accurate, lawful and yours to use, or that you have permission to use it;
- check and approve work where a plan asks you to, in good time;
- follow the rules of the platforms we work on for you (such as Google, Meta, eBay, Amazon and Etsy);
- tell us quickly if something we have published is wrong.
If you do not give us what we need, we may be unable to deliver your plan. That is not a reason for a refund of the period already paid.
You are responsible for any claims caused by content or information you give us. You agree to cover our reasonable losses if a third party makes a claim against us because of it.
7. Approvals
- Changes to your ads are applied with your approval, or we just get on with it if you prefer: your choice.
- Review replies can be set to “approve first”.
- You can approve each email first, or let it send automatically.
- Press releases go out only after you approve them.
If you choose to let work go out automatically, you accept it is published without your prior review.
8. Ads and ad spend
Ad spend is not included in our prices. You pay it directly to Google or Meta, through your own ad account. Each ads plan has a monthly ad spend cap shown on its page (up to £2,000, £7,500 or £20,000 a month). If your ad spend goes over your plan’s cap, we keep managing your ads for that month and contact you about moving to a bigger plan. We never charge extra without your agreement.
9. Third-party platforms and tools
We work on platforms and use tools that we do not own or control, including Google, Meta, Mailchimp, Brevo, eBay, Amazon, Etsy, WooCommerce and our AI providers. We are not responsible for their changes, outages, decisions or rules, or for any suspension or restriction of your accounts by them, unless we caused it by breaking these terms.
10. Prices, VAT and payment
- All prices are shown + VAT. VAT is added at checkout at the current rate.
- Setup is free. We do not offer trials.
- Plans are paid in advance, monthly or yearly. Items priced “each” are one-off purchases, paid at checkout.
- We take payment by card through Stripe. You can also pay for one-off items through PayPal. Plans renew automatically by card through Stripe.
- If a payment is late, we may charge interest and compensation under the Late Payment of Commercial Debts (Interest) Act 1998, and we may pause work until it is paid.
Our subscription terms explain renewals, failed payments and price changes.
11. Cancelling
Monthly plans have no contract: you can cancel anytime. You can cancel from your account on our website. Our subscription terms and refund and cancellation policy explain when cancellation takes effect and when refunds apply.
12. Ownership of the work
- Once you have paid for it, you own the final content we make for you, such as articles, posts, listings, pages, newsletters and magazine pages.
- We keep ownership of our own tools, software, bots, prompts, templates, processes and know-how. These are never transferred to you.
- You give us permission to use your content, logos and information only to deliver your plan.
- We may show anonymised examples of our work (without your name) to show what we do, unless you ask us not to.
When a plan ends:
- paid-for content already published on your accounts stays yours and stays up;
- a Powerful Bots chatbot is switched off and its data is deleted within 14 days;
- magazine flipbook hosting stops at the end of the paid period;
- we remove our access to your accounts;
- if you ask, we send you copies of the files we made for you within 30 days.
13. Confidentiality and data protection
We each keep the other’s confidential information private, and only use it to carry out this contract.
Our privacy policy explains how we use personal data. Where we handle personal data for you, our data processing agreement applies.
14. Our liability
- Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.
- We are not liable for loss of profit, revenue, sales, business, goodwill, data or opportunity, or for any indirect or consequential loss.
- Our total liability to you under or in connection with the contract is limited to the fees you paid us in the 3 months before the claim.
- We will carry out our services with reasonable care and skill.
15. Pausing or ending the contract
We may pause or end your plan by email if you do not pay, if you seriously break these terms, or if you ask us to do something unlawful or against a platform’s rules. If we end a plan for another reason, we will refund any amount paid for work we have not yet done.
16. Events outside our control
We are not responsible for delays or failures caused by events outside our reasonable control, such as platform outages, internet or power failures, or changes made by Google, Meta or our AI providers. We will tell you and try to keep the effect as small as possible.
17. Subcontractors
We do not use subcontractors. The other businesses we work with, such as the service providers listed in our privacy policy and data processing agreement, handle data under their own data protection and GDPR terms.
18. Changes to these terms
We may update these terms. The version on this page when you order applies to that order. For existing plans, we will tell you about important changes by email before they apply, and you can cancel if you do not agree.
19. Other important terms
- We may send notices to the email address on your account. You can send notices to info@powerfuldigitalmarketing.com.
- If a court decides part of these terms cannot be enforced, the rest still applies.
- Only you and we have rights under this contract. No one else can enforce it.
- If we do not enforce a right straight away, we can still enforce it later.
20. Law and courts
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute.
